A webinar intended to explain a tax change turned instead into the clearest warning the island nation’s tourism industry has received in years.<\/p>\n
The Tourism Ministry, the Finance Ministry, and the Maldives Inland Revenue Authority (MIRA) jointly held the said webinar at 17:00hrs on Tuesday evening to brief foreign tour operators on the amendment to the Goods and Services Tax (GST) Act, which brings overseas booking platforms, travel agents and tour operators within the Maldivian GST net from next month.<\/p>\n
Some 800 participants joined. Over the course of roughly 45 minutes, the live chat filled with anger, and not one participant spoke in support of the amendment.<\/p>\n
A considerable number of them told the government, in terms leaving very little room for interpretation, that they will remove the Maldives from their portfolios and stop selling it.<\/p>\n
What did they actually say?<\/h2>\n
The comment which drew the most attention came from an account trading under the name Mary Maldives Vacations.<\/p>\n
Before the sea level rises and takes the Maldives under, the writer said, this additional tax will sink the country first. The Maldives has been in their tour operator line-up for 30 years, and it will now be taken out, with travelers directed instead to destinations which are easier and cheaper to sell.<\/p>\nPhoto extracted from Dhauru<\/figcaption><\/figure>\n
Others followed in much the same vein. One operator said plainly that there could be no cooperation with the amendment, because the government had decided to tax a service which the operator renders outside the Maldives, and upon which tax is already being pain in the operator’s own country.<\/p>\n
The complaint of double taxation, recurred throughout the session, along with the assertion that no other country does this.<\/p>\n
One participant argued that the measure is not a VAT at all but a corporate tax wearing a VAT’s clothing, and expressed the hope that the government had thought through the consequences.<\/p>\n
Another set out the structural objection in a single line: a guest who books directly with a resort pays no such tax, which means the tour operator is pushed out of the market by design.<\/p>\n
The remainder of the chat consisted largely of operators saying where they will send their clients instead. Seychelles, the Red Sea in Saudi Arabia, Fiji, French Polynesia, and Mauritius were some of the alternatives thrown around during the webinar.<\/p>\n
“The world is a very large place,” one of them wrote. “There are hundreds of beautiful destinations like the Maldives. Why should we sell the Maldives at twice the price of other tropical destinations?”<\/p>\n
Who turned up to face them?<\/h2>\n
This part will become remembered by the industry in the decades to come.<\/p>\n
With roughly two weeks remaining before the amendment takes effect, and with several hundred angry foreign operators assembled in one virtual room, no head of any relevant government institution appeared before them.<\/p>\nPhoto extracted from Dhauru<\/figcaption><\/figure>\n
The Tourism Ministry set a legal representative, a personal secretary and one other official. Minister Mohamed Ameen was nowhere to be seen. MIRA’s Commissioner General of Taxation did not attend, notwithstanding that foreign operators have been addressing letters of complaint directly to her office. The Finance Minister did not attend either.<\/p>\n
A Maldivian participant in the webinar said afterwards that the scale and manner of the foreign operators’ displeasure left him embarrassed.<\/p>\n
What remains unanswered?<\/h2>\n
A great deal in fact, was left unanswered. The webinar, raised more questions and concerns than answered or alleviated them.<\/p>\n
Will an agent who merely books a ticket to the Maldives also be liable? Were the discounts, free nights, rebates, cancellation fees and sub-agent commissions which are ordinary features of package selling taken into account when the amendment was drafted? And where a package covers the Maldives alongside another destination for a single combined price, how is the Maldivian portion of that price to be identified at all?<\/p>\n
None of these received a rightful answer at the session, leaving the various tour operators and industry stakeholders who took part in the webinar frustrated.<\/p>\n
How does this sit with the international response?<\/h2>\n
The webinar is not an isolated flare-up. It is the point at which a dispute already running for a month reached the people who actually sell the destination.<\/p>\n
President Muizzu ratified the Eighth Amendment on 31 August, four days after ABTA, which represents around 3,500 UK consumer brands, wrote to Minister Ameen asking the government to pause implementation and consult. ECTAA, based in Brussels, wrote in parallel to the Maldivian Ambassador to Belgium and the European Union.<\/p>\n
Since then the French association Les Enterprises du Voyage and the tour operating union SETO have jointly written to MIRA, asking that commencement be pushed to an agreed date in 2027 and pointing out that the rules draw no distinction by the size of the business, which leaves smaller French operators facing costs they may be unable to absorb.<\/p>\nThe absence of a Minister or other senior government officials privy to more intimate information at the webinar is disparaging and will be read as an answer in itself by international tour operators<\/figcaption><\/figure>\n
A petition has been circulating among foreign agents arguing that commissions and margins earned outside the Maldives ought not to be treated as tourism services supplied within it. MATATO, which represents the industry at home, has opposed the amendment as well.<\/p>\n
The recurring technical objection across all of them is the same. Operators price and sell packages up to a year in advance, the winter season is already sold at agreed prices, and European consumer protection rules bar them from surcharging a customer after the sale. The tax therefore lands on the operator’s margin rather than the traveler’s invoice.<\/p>\n
The government has given no indication that it intends to withdraw the amendment.<\/p>\n
Why the timing is worse than it looks<\/h2>\n
The economic background comes into the picture here, and it is of more concern than the tax argument itself.<\/p>\n
The island nation is not approaching this winter from a position of strength. Foreign currency has been scarce for the better part of a year, telegraphic transfers rare taking weeks to clear, and businesses have been buying dollars on the informal market at rates well above the official one simply to pay their suppliers. Port congestion at Colombo and berthing delays at Mal\u00e9 have left containers of food sitting in stacks for over a month. Small and medium enterprises have warned they are heading towards closure.<\/p>\n
Tourist arrivals in August fell by 1.9 percent against the same month last year. General GST (GGST), went backwards by 4.1 percent in the same month. MIRA’s own August figures show that a little over one fifth of the month’s entire revenue had to be brought in through enforcement rather than ordinary compliance.<\/p>\n
Against that, the amendment is projected to raise MVR 1.6085 billion a year, roughly USD 104 million, which is real money for a treasury under strain.<\/p>\n
Of course, the state’s reasoning is not difficult to follow. Some USD 2 billion of tourism value is understood to be settled offshore and never reaches the Maldivian banking system, and the destination principle is a legitimate response to that. No serious person disputes the right of the Maldives to tax consumption occurring on its own reefs.<\/p>\n
The Bottom Line<\/h2>\n
The issue here is not about the government’s move towards the tax amendment, but the six weeks. The short span of time before this new law becomes effective, leaving little to no room for international tour operators to adjust to the change.<\/p>\n
New Zealand consulted for the better part of three years before extending GST to offshore sellers. Australia phased its version in across two budgets. The Maldives has given the world’s travel trade from mid-August to the first of October, and has done so in the season when the winter book is already closed.<\/p>\n
The threat now on the table is not a threat to revenue collection, but one to distribution. A tour operator does not need the Maldives; the Maldives needs the tour operator, and the difference between those two positions is the whole of the leverage in this dispute. Ninety-nine percent of the country’s foreign exchange earnings come from a single industry, and a meaningful share of that industry’s bookings arrives through precisely the firms which spent Tuesday evening saying they will sell other destinations instead.<\/p>\n
Whether they follow through is another matter, and trade bodies have made louder threats before and quietly carried on trading. But the government did not send a minister to find out, and that absence will be read in Munich, Milan and everywhere else as an answer in itself.<\/p>\n","protected":false},"excerpt":{"rendered":"
